1. The policies below are applicable to RhumsikyPay card site.

2. The services on this site  are powered by Rhumsiky e-Systems LLC, a global e-commerce solution provider company that facilitate access  to e-technologies to customers all over the world.  This document constitutes the agreement "Agreement" outlining the terms and conditions under which the services has been issued to you. In this Agreement "you" and "your" mean the person or persons who have purchased the services and are authorized to use the  service as provided for in this agreement. "The company" mean Rhumsiky e-Systems LLC,  it's successors, affiliates or assignees. The service is nontransferable, and it may be canceled, repossessed, or revoked at any time without prior notice subject to applicable law. Please read this Agreement carefully and keep it for future reference. By accepting and using the services, you agree to be bound by the terms and conditions contained in this Agreement.

 

3. The Company is not a bank or a credit institution and does not offer financial services such as loans, credits, depository and any other banking service. The company provide you a virtual, prepaid Visa card (hereinafter the " RhumsikyPay card ") a pre-paid, stored value card that, that once activated, can be used to make Visa transactions over the Internet. Only electronic commerce transactions identified as such in the authorization request will be considered for authorization. The company does not issue any virtual Visa, service is brought to you through different suppliers and source companies eligible to issue virtual payment cards to facilitate our users.

 

4. Our business days are Monday through Friday excluding holidays. Saturday, Sunday, and federal holidays are not considered business days, even if we are open. Our working hours are from 8 am to 5 pm US central time. 

 

5. When you purchase a RhumsikyPay card,  you automaticaly become the cards owner when its shipped to you by any shipping method that we may decide to use. You are solely responsible to keep your cards details and we are not responsible for any fraudulent use of a card that has already been delivered to you. We will never reveal your information to any third party as refered in our Privacy policy .

6. The Company reserves the right to accept or reject any order, load request, at its sole discretion, for any reason whatsoever. The RhumsikyPay card expires one year from date of issuance. After the expiration date, the RhumsikyPay card cannot be cancelled, and no remaining balance will be refunded.

7. Authorizations will not be given to merchants processing authorization requests in amounts exceeding the remaining RhumsikyPay card balance. If a merchant attempts to process a transaction in an amount exceeding the current RhumsikyPay card balance, the transaction will be declined. However, if, for any reason, a transaction is processed for an amount exceeding your RhumsikyPay card balance, you are liable for the entire transaction amount. The company reserves the right to automatically deduct such excess amounts from any available funds available now or in the future on this RhumsikyPay card or any other RhumsikyPay card (s) you may obtain.

8. You are responsible for monitoring transactions charged to the RhumsikyPay card. The current balance on the RhumsikyPay card is available by request to customer support service.

9. The company is not liable for any inconvenience caused or loss incurred due to failure to approve a transaction by any merchant, non-receipt of merchandise or services, or unsatisfactory merchandise or services. The company is not responsible for the delivery, quality, safety, legality of goods and services purchased by the cardholder with the RhumsikyPay card, or any aspect thereof, or for any cancelled recurring transactions.

10. Refunds and cancelled transactions are credited to the RhumsikyPay card provided they fully match the original debit transaction and the relevant merchant. Credit transactions in currencies other than the load currency will be converted to US Dollars, using the generally authorized Visa rates in effect, and subsequently converted to the load currency. Payouts cannot be credited to a RhumsikyPay card. Conversion commissions will not be credited. A credit transaction that results in a RhumsikyPay card balance exceeding the maximum load amount may be rejected.

11. RhumsikyPay card may not be used to enable a funds transfer. The Company is not responsible for any unauthorized transactions.

12. It is your responsibility to verify the legality of the transaction you intend to make since laws vary from country to country and from jurisdiction to jurisdiction. RhumsikyPay card will not be used for gambling/gaming/betting and like transactions. By purchasing a RhumsikyPay card or by retaining, using or authorizing the use thereof, you represent and warrant that you are at least eighteen years of age and have reached the age of majority in your country, and you agree to be bound by the terms and conditions contained in this Agreement.

13. "Recurring transactions" are transactions that are automatically charged to your RhumsikyPay card on a regular basis. Examples of such transactions include, but are not limited to, subscription services, Internet provider charges, or insurance premium payments. Since this card is prepaid, these merchants may suspend or cancel your service if your RhumsikyPay card balance is not sufficient to cover the amount of the recurring transaction when it comes due.

14. Funds will be withheld for any transaction that has been "authorized," and this amount will not be available to you for use elsewhere. The Company cannot manually release a legitimate authorization without notice from the merchant and his Visa center that no additional charge will be forthcoming.

15. The RhumsikyPay card is available for use until the date of expiration, provided that it contains a balance, and has not been previously blocked or cancelled. You may order as many cards as you wish. 

 

16. If you are entitled to a refund for any reason for goods or services obtained with your Card, you agree to accept credits to your Card for such refunds. It may take up to seven (7) days  or more for the amount of the refund to be credited to your Card.

 

17. When you purchase a RhumsikyPay card, once your payment is received, verified and confirmed, your order will be processed and you shall received your card within 24 hours. Once your order has been processed, you are not entittle to any refund of the purchased card.

 

18. If your RhumsikyPay card is lost or stolen, we will not be held responsible and we are currently not replacing cards that have already  been issued.

19. We may disclose information to third parties about your RhumsikyPay card or the transactions you make: where it is necessary for completing transactions; In order to verify the existence and condition of your Card for a third party, such as merchant; In order to comply with government agency, court order, or other legal reporting requirements; If you give us your written permission; To our employees, auditors, affiliates, service providers, or attorneys as needed.

20. We will not be liable:  If, through no fault of ours, you do not have enough funds available on your Card to complete the transaction;  If a merchant refuses to accept your Card;  If an electronic terminal where you are making a transaction does not operate properly, and you knew about the problem when you initiated the transaction;  If access to your Card has been blocked after you reported your Card lost or stolen or after you violated a policy;  If circumstances beyond our control (such as fire, flood or computer or communication failure) prevent the completion of the transaction, despite reasonable precautions that we have taken;  Any other exception stated in our Agreement with you.

21. If any provision of this Agreement shall be determined to be invalid or unenforceable under any rule, law, or regulation of any governmental agency, local, state, or federal, the validity or enforceability of any other provision of this Agreement shall not be affected.

22. We may amend or change the terms of this Agreement at any time. You will  not be notified of any change in the manner provided by applicable law prior to the effective date of the change. Its your responsibility to review this policy every time you use The company site. We may cancel or suspend your Card or this Agreement at any time. You may cancel this Agreement by stop using our card or services. Your termination of this Agreement will not affect any of our rights or your obligations arising under this Agreement prior to termination. This Agreement was last updated on 04th May 2009.
